Participation Agreement

Scope of this agreement

This Agreement applies to every Luna Volleyball Academy ("LVA") program, club team, clinic, camp, private lesson, event and training session, current and future, in which the participant enrolls. "I" means the participant, or the parent or legal guardian registering a participant under 18. By completing registration or clicking Accept, I agree to this Agreement on my own behalf and on behalf of my child.

I. Acknowledgment of risk

I understand the nature of volleyball, jump and strength training, conditioning and the other athletic activities offered by LVA. I confirm the participant is in good health and physically able to take part.

I understand that participating carries risks, including but not limited to sprains, strains, tendinitis, joint injuries, concussion and other injuries, which can be serious. These risks are inherent to the sport. I voluntarily assume all of these risks on behalf of the participant.

II. Release of liability

To the fullest extent permitted by law, I release, waive, discharge and agree not to sue Luna Volleyball Academy, its owners, directors, coaches, instructors, staff, volunteers and affiliated entities (together, "LVA") from any and all liability, claims, demands and causes of action arising out of or related to any loss, damage, injury or death the participant may suffer while taking part in any LVA program or event, traveling to or from it, or while on or about LVA premises or tournament sites. This release includes claims based on the negligence of LVA, to the extent permitted by Texas law.

I agree to indemnify and hold LVA harmless from claims brought by or on behalf of the participant that are covered by this release. I have read this release, understand it and sign it freely.

III. Medical and emergency authorization

• I authorize any LVA coach, instructor or staff member to act on my behalf and use their best judgment in any emergency requiring medical attention, including calling emergency services and arranging transport.
• I am responsible for all medical costs incurred.
• I will tell LVA about any medical condition, allergy or injury that affects the participant's safety, and keep emergency contact information current.
• A participant suspected of a concussion will be removed from play and may return only with written clearance from a licensed medical provider.

IV. Code of conduct

LVA provides a safe, respectful and positive environment. Athletes, parents and guardians agree to:

• Treat coaches, staff, officials, athletes, families and facility personnel with respect at all times.
• Arrive on time and prepared to train, with proper athletic clothing and court shoes.
• Avoid profane, abusive, threatening or discriminatory language or behavior, in person and online.
• Follow the instructions of LVA coaches and staff.
• Keep phones away during training unless staff direct otherwise.
• Respect the facility, equipment and the property of others.
• Bring concerns to the coach or to admin@lunavolleyballacademy.com privately, not during practices or matches.

Dismissal: behavior LVA judges to be seriously disruptive, disrespectful, unsafe or inappropriate may lead to immediate dismissal from a session, program or team without a refund or credit. LVA may decline future enrollment to anyone who violates this code.

V. Attendance, refunds and cancellations

All attendance, make-up, refund, credit and cancellation terms are set out in the LVA Refund Policy, which is part of this Agreement. In summary:

• Club team fees are a season commitment and are non-refundable once a team spot is accepted.
• Programs, camps and clinics: full refund up to 7 days before the first session, full credit inside 7 days, and no refund after the first session.
• Private lessons and drop-ins need at least 24 hours notice to cancel or reschedule.
• Missed sessions are not made up, refunded or credited.
• Injury or illness: prorated credit with a note from a licensed medical provider.

If this summary and the Refund Policy ever differ, the Refund Policy controls.

VI. Photo, video and name release

I authorize LVA to take photographs, video and audio recordings of the participant during LVA programs, practices, tournaments and events, and to use them for LVA purposes, including our website, social media, promotional materials, instructional and training videos, and video analysis, without payment or other compensation.

LVA may publish the participant's first name, last initial, jersey number and team on team rosters and in results. LVA does not publish athletes' full birth dates, home addresses, school schedules or contact details.

To opt out of promotional use of your athlete's image, email admin@lunavolleyballacademy.com. We will stop future promotional use. Team photos and game footage may still include the athlete.

VII. Club team commitment

• Accepting a club team spot is a commitment for the full season, including practices, tournaments and fees.
• Team placement, playing time and positions are decided by LVA coaches based on development, effort and team needs.
• Families are responsible for their own travel and lodging for tournaments unless LVA states otherwise.
• Athletes must hold a current USA Volleyball and North Texas Region membership, as required for club play.

VIII. Communication

I agree that LVA may contact me by email, text message and team messaging apps about schedules, registrations, payments and program updates. Message and data rates may apply. I can opt out of marketing messages at any time; program messages continue while my athlete is enrolled. LVA handles personal information as described in the Privacy Policy.

IX. General terms

• LVA may change schedules, locations, coaches or program details when needed. Changes are posted on the website or shared by email.
• LVA may update this Agreement. The version in effect when you register applies to that registration.
• This Agreement is governed by the laws of the State of Texas. Any dispute will be handled in Collin County, Texas.
• If any part of this Agreement is found unenforceable, the rest stays in effect.

Acceptance

By completing registration or clicking Accept, I confirm that I am at least 18 years old, that I am the participant or the participant's parent or legal guardian, and that I have read, understand and agree to this Agreement, the Refund Policy and the Privacy Policy.
